Sa statement, sinabi ng DPWH na ang pag-turnover nila sa files ni Cabral ay bilang pagtalima sa Subpoena Duces Tecum ng Ombudsman, na nag-aatas sa ahensya na isurender ang lahat ng computers at devices na inisyu sa yumaong DPWH official.
