Inihayag ng abogado ng senador na si Atty. Maria Fricela Kim, na dahil hindi na makapagpatuloy ang prosekusyon nang walang kooperasyon ng Private Complainants, nagpasya ang hukom na idismis ang kaso bunsod ng kakulangan ng ebidensya at idineklarang Not Guilty si Fermin.
