Ayon sa DOLE, ang 13th month pay ay dapat ibigay sa lahat ng rank-and-file employees anuman ang kaniyang posisyon, designation o employment status basta’t nakapagtrabaho na siya sa kumpanya sa loob ng hindi bababa sa isang buwan.
