Ayon kay DOJ spokesperson Polo Martinez, sa resolusyon ng piskalya, napatunayan na hindi ang mag-asawang Discaya ang nag-import ng mga luxury vehicle kaya hindi sila ang dapat habulin sa hindi nabayarang excise tax.
Ipinaliwanag ni Martinez na ang dapat managot sa sa pagbabayad ng excise tax ay ang nag-import ng sasakyan o kung kanino mismo binili ang sasakyan.
Sangkot sa nasabing reklamo ang luxury vehicles nina Discaya kabilang ang Land Rover at ang Cadillac Escalade para sa isa sa mga kaso; isang Land Rover at isang Mercedes-Benz para sa ikalawang kaso at ang Mercedes-Benz para sa ikatlong kaso.
